These Terms of Service ("Terms") govern your use of Juke, including the website at try-juke.com, the installable web app and any related services (together, the "Service"). Juke is operated by Melotech Inc. ("Juke", "we", "us" or "our"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Messages from us. By signing up for Juke you agree to receive text messages (SMS) at the phone number you provide and emails at any email address you give us. We use these to send sign-in codes, account and service notices, and to reach out with questions about your experience so we can improve Juke (for example, short surveys or feedback requests).

Message frequency may vary. Message and data rates may apply. Reply STOP to any text to stop receiving them, or HELP for help. You can unsubscribe from emails with the link in any email or by contacting us. Consent to these messages is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages.

1. Eligibility

You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live (or have a parent or guardian's permission). If you use the Service on behalf of an organization, you confirm you are authorized to accept these Terms for it.

2. Your account

You sign up with a mobile phone number that you own or are authorized to use. You are responsible for keeping access to that number and your devices secure, and for everything that happens under your account. Tell us promptly if you believe your account has been used without your permission. You may not create accounts by automated means or under false pretenses.

3. Using Juke

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to stream the music and other content available on the Service for your own non-commercial use. You agree not to:

copy, download, record, rip, redistribute, sell or publicly perform content from the Service, except through features we provide for that purpose (such as share links);
circumvent any technical protection, rate limit or access control, or use bots, scrapers or other automated means to access the Service;
artificially inflate plays, rewards, referrals or other metrics, or otherwise game any feature of the Service;
reverse engineer, decompile or interfere with the Service or its infrastructure, except where the law expressly allows it;
use the Service for anything unlawful, harmful, or that infringes anyone else's rights.

4. Content and ownership

The Service, including its software, design, branding, music and other content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license above, these Terms do not give you any rights in it. If you send us feedback or suggestions, you allow us to use them without any obligation to you.

5. Rewards and promotions

We may offer coins, perks, referral bonuses or other rewards. Rewards have no cash value, are not your property, cannot be sold or transferred, and may be changed, limited, expired or withdrawn at any time. We may void rewards earned through fraud, automation, multiple accounts or any breach of these Terms. Specific promotions may have additional rules, which will apply alongside these Terms.

6. Changes to the Service

Juke is a new and evolving product. We may add, change, suspend or remove features, stations or content at any time, and we may limit or discontinue the Service, with or without notice.

7. Suspension and termination

You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we reasonably believe it is necessary to protect the Service, other users or us. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability and disputes) will survive.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not promise that the Service will be uninterrupted, error-free or secure, or that any content will remain available.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JUKE AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

10. Indemnity

You agree to defend and indemnify Juke against claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.

11. Disputes and governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, give you notice in the app or by message. Continuing to use the Service after changes take effect means you accept the updated Terms.
